**Recent Settlements and Judgments**Personal Injury: Auto/Pedestrian - On May 26, 2009, Mr. Boyd was legally crossing the street at a crosswalk in Austin when a driver failed to yield the right-of-way and hit Mr. Boyd. As a result, Mr. Boyd suffered a complex collar bone fracture requiring surgery to implant hardware to repair the fracture. Despite the fact that the driver's insurance company denied coverage, twice, our attorneys were successful in invoking coverage and settling the case for the driver's policy limits of $25,000.00. Our attorneys also negotiated Mr. Boyd's health insurer's reimbursement interest by 50%, thereby increasing his net recovery. Gross Amount Received = $25,000.00; Personal Injury: Auto/Auto - On May 3, 2008, Mr. Fairchild was riding as a passenger in the vehicle driven by Mr. Madeley. Mr. Madeley began texting/talking on his cell phone, disregarded a yield sign, failed to yield the right-of-way to another vehicle, and caused a collision. As a result of the collision, Mr. Fairchild received various severe injuries, including a right orbital blowout fracture. The insurance company for Mr. Madeley took advantage of the fact that Mr. Fairchild, a minor, was not represented by legal counsel and negotiated an early settlement for insufficient compensation. At the time, Mr. Fairchild had not even received medical treatment for all of his injuries as he had no health insurance. Our attorneys successfully threw out the insufficient settlement agreement, got Mr. Fairchild the medical care he needed (including oral surgery) and obtained a settlement of approximately 4 times the original amount offered by the insurance company. Our attorneys also negotiated Mr. Fairchild's medical bills down an average of 40%, thereby increasing his net recovery. Gross Amount Received = $117,042.00; Personal Injury: Auto/Pedestrian - On May 13, 2008, Ms. Waugh was legally crossing the street at a crosswalk in downtown Austin when a driver failed to yield the right-of-way and hit Ms. Waugh as she crossed the street. The driver, who was driving a large F-250 Super Duty pick-up truck, made a wide and dangerous left turn, accelerated through the turn, and slammed his vehicle into Ms. Waugh. Despite Ms. Waugh's desperate attempt to get out of the way, the driver hit her with the front of his F-250 and launched her entire body approximately 6 feet into the air. Ms. Waugh crashed down onto the hood of the F-250, bounced off the hood, and struck the asphalt. On behalf of Ms. Waugh, our attorneys were able to quickly recover the insurance policy limits of the driver's auto insurance policy AND the insurance policy limits of Ms. Waugh's own auto insurance policy under her underinsured motorist coverage. Gross Amount Received = $45,000.00; Personal Injury: Auto/Auto - On July 7, 2007, Mr. Tannehill was injured when another driver, who was traveling northbound on Loop 1 in Austin, Travis County, Texas, failed to maintain control of his Chevrolet 1500 pick-up truck while driving at high speed. The other driver lost control of his vehicle, drove through a large grass median, hit a light pole, and crossed into southbound traffic. Mr. Tannehill, who was traveling south in the left lane of Loop 1, performed a life-saving evasive maneuver to avoid a head-on collision. Although Mr. Tannehill was able to avoid the head-on collision, he was unable to completely avoid the other driver and was struck on the driver's side of his vehicle at high speed, suffering shoulder and neck injuries as a result. On behalf of Mr. Tannehill, our attorneys were able to recover the insurance policy limits of the other driver's auto insurance policy, the insurance policy limits of Mr. Tannehill's own auto insurance policy under his underinsured motorist coverage, and the insurance policy limits available under the Personal Injury Protection coverage of Mr. Tannehill's own auto insurance policy. In addition, our attorneys negotiated a 40% reduction of Mr. Tannehill's health insurance company's subrogation claim, effectively saving Mr. Tannehill ~$5,000.00 and ensuring that his future healthcare needs would be covered. Gross Amount Received = $45,000.00; Personal Injury/DWI - On October 9, 2008, Mr. Lira, Ms. Huerta and her 4 minor children were driving home from school and work when a drunk driver crossed the center lane of the highway on which they where travelling and hit their vehicle head-on. Our attorneys were able to settle the case for the responsible party's insurance policy limits of $300,000.00 within 4 months of the start of representation. On behalf of the clients, our attorneys negotiated approximately $200,000.00 in medical bills down to approximately $115,000.00, resulting in a direct benefit to the clients of an additional $85,000.00 in money saved. In addition, our attorneys are working to help the clients collect additional funds from the State's Crime Victim's Compensation Fund to assist them with future medical care and lost wages.
